Terms & Conditions
Please take time to read these terms and conditions it is important for both of us that you understand our contractual relationship. Your contract is with Ecospheres AB, Havsvägen 20, 370 24 Nättraby Sweden. A binding contract is only entered into when you have accepted a booking proposal, by email och phone. By contacting us, and/or your travel agent, to make a booking you accept that you have the authority to bind all members of your party to these terms and conditions. It is essential that you check the travel details on the confirmation invoice and inform us immediately of any errors. Your booking is also subject to the conditions of carriage of your chosen airline.
Trips booked through Ecospheres adhere to the terms & conditions of The Association of Swedish Travel Agents and Tour operators and Swedish "packaged travel law"
Anyone who arranges or sells travel arrangements regulated in the Travel Guarantees Act (1972:204) must, prior to selling or marketing these arrangements, lodge security with the Swedish Legal, Financial and Administrative Services Agency. The purpose of the Act is to protect travellers if a travel arrangement is cancelled or interrupted, usually because the operator has gone bankrupt. Ecospheres has lodged a security/ a travel guarantee with Kammarkollegiet in accordance with Swedish Law and in order to secure and protect the traveller in case of cancelled travel arrangements, interrupted arrangements or the unlikely event of our insolvency. The amount guaranteed can be used to recompense the costs of any advance payment, full payment, value of the benefits which were included in the travel arrangement and possible repatriation costs. If for some reason the arrangement is not completed, the guarantee can be used to reimburse the affected travellers. The obligation itself to lodge security is considered to contribute to the goal that only operators with sufficient means to protect their customers will actually venture into the travel business.
The trips can be booked through www.ecospheres.se, via telephone or email.
Payment for your holiday:
A deposit of 20% of the total holiday price is required at the time of booking. We reserve the right to vary the deposit as appropriate. The deposit must be paid latest ten days after received confirmation. Final payment is due 50 days before departure unless other is specified. Holidays booked later than 50 days prior to departure, must be paid in full, within 5 working days. The deposit is 3000 SEK per person. In some instances the hotel wishes a larger sum in order to secure the booking. When the deposit has arrived to us, the booking is legally binding for both parties. If any balance remains unpaid, travel documentation will not be issued and we reserve the right to treat your booking as cancelled and apply the cancellation charge set out below.
Final travel documents will usually be sent out approximately 2 weeks before departure. All money paid to a travel agent will be held by the agent on our behalf. Payment must be in the currency of the invoice and you are responsible for bank charges. If the currency exchange rate has changed at the time of final payment, Ecospheres reserves the right to adjust the price of the holiday. This must be done, latest 20 days prior to departure. Cancellation insurance is not included in the price of the holiday. The traveller can protect him/herself against costs through buying a travel insurance. The traveller is then protected according to Swedish Law and the Package travel directives - Allmänna Resevillkoren. Costs as a result of a cancellation will occur.
Payment will be made to our Swedish bank, SE-Banken, in the currency shown on the invoice.
Amendment and cancellation by you:
We will do our best to assist you in altering your arrangements after booking but cannot guarantee this will be possible. If alterations can be made you will be responsible for all extra charges and costs and we reserve the right to charge a 500 SEK administration fee per person plus any applicable charges levied by our suppliers. Change of hotel, standard of room, departure date or destination will be treated as a new booking.
(B) CANCELLATION WITH CANCELLATION INSURANCE
All cancellations must be made in writing by the person who made the booking and are effective on the day we receive it. The client has the right to cancel the holiday, provided a medical certificate can be shown. The certificate must assure the illness is of emergency character and that the illness was not known at the time of booking the holiday. If cancelling a holiday, all itineraries sent to you from Ecospheres must immediately be returned. Reimbursement will occur only after we receive the itineraries.
Cancellations without cancellation insurance:
Cancellation policy for holiday packages and costs applied due to cancelling, if nothing else is being advised. Note that we can not reimburse you for booked flights, you may be able to change dates at a cost, this is subject to the rules and regulations of the particular airline:
More than 30 days prior to departure, the cancellation fees from the supplier and the deposit of 3000 SEK per person will be charged.
Less than 30 -15 days prior to arrival, 50% of the total holiday package. Less than a 100% of the total cost will be charged unless other is advised.
The penalties are in addition to the non-refundable elements of the booking which have been contracted on your behalf and notified to you. If we are able to recover any of our losses from our suppliers, we will refund those to you subject to a reasonable administration fee. Please note that travel insurance premiums are not refundable in any circumstances. Agents or third party organisations acting on our behalf are unable to amend or change the contract or terms and conditions within it.
Cancellation with insurance:
In case of cancelling of trip for a traveler who has subscribed and paid cancellation insurance, the following applies: the passenger must contact us in writing and after wich we will cancel the trip .
Passenger's right to transfer the contract
In many cases, changing traveler involves direct costs where the airline ticket rules is the major reason. All costs of the name changes, cancellation or other administrative measures will be paid by the traveler to the fullest.
No refunds are given for events that are not used. For example if the traveler decides to move from the hotel earlier than planned.
Hotel Vouchers and other travel documents are sent along with programs about 8-10 days prior to departure.
Traveler's responsibilities during the trip
The traveler is responsible for reading the current travel conditions before purchase of the trip and must also be aware that the journey is unaccompanied. The traveler is committed to:
• check that the confirmation is corresponding with the order.
• check the travel documents as soon as they are received. Any errors must be immediately be highlighted to ecolyx for further action.
• show up well in time to pre-booked hotels and tours.
• Vaccinations. The traveler is responsible for contacting the vaccination center to get accurate recommendations for their trip well in advance.
• Passport and visa. The passport must be valid 6 months after your departure. In cases where visas are required this will be clear from information presented to the traveler after booking. The passenger is responsible for visa application using instructions from Ecolyx.
• Travel insurance. The traveler is responsible for his own insurance and is also responsible for making sure the insurance covers all the activities organised during the trip, for example; riding. These activities are given for each trip. Documentary evidence regarding travel insurance should be brought on the trip, even out in the wilderness.
We are happy to pass on travel insurance if you need to supplement your home insurance. Contact us for separate information. Ecospheres does not pay for any expenses that may arise if the above points are not followed.
Ecospheres can not be held responsible for situations resurrected from strikes, storms, extreme weather conditions, political instability, terror attacks or any other force major situations we have no control of. We help to find a suitable solution but can not accept any financial responsibility in terms of changes in flight times, airlines, flight routes, transportation or overnight stays outside the regular itinerary. Missed tours, hotels and transportation will not be replaced, but we will do our best to help you deal with the situation.
Deficiencies during the trip
If dissatisfaction arises during the journey, it is the traveler's responsibility to contact the organizer immediately so that the organizer will be able to solve the problem on the spot. In case of eventual complaints: If the traveler is not satisfied with their accommodation or similar, as agreed under the contract , and the situation can not be resolved directly between Ecospheres and the traveler when at the destination, the traveler must soon after homecoming (maximum 2 months) make a claim to Ecospheres. It is important to take the names of people who the traveler has come in contact with on this issue and keep receipts for any additional costs that has occurred.
Ecospheres act as an agent for the hotels and other businesses with whom an agreement has been signed.
We are not responsible for any deficiencies that may be due to negligence on the passenger side, third person or circumstances which we could not foresee, avoid or avert the case of force majeure.
Requests during the trip
Note that Ecospheres can not guarantee specific requests from travellers, such as the placement of rooms and early check-in / late check out at the hotel, etc. A travellers request is not something that can be confirmed before departure but we will do everything in our power to make the traveler 's trip as pleasurable as possible.
In the occurrence of operators/organisers are changing rules and rates, we reserve the right to make corresponding changes to the customer. Price changes before departure can occur as a result of new or revised taxes, fees, exchange rates and other factors that we can not possibly predict. We reserve the right to correct clerical errors on the Ecospheres' website.
When buying a package tour ( a trip consisting of transportation and additional arrangements, such as accommodation or activities) for package travel law. Ecospheres has lodged a security/ a travel guarantee with Kammarkollegiet. This guarantee means that the traveler is entitled to compensation for canceled or interrupted trip in the event that Ecospheres's insolvency or bankruptcy. Claims for reimbursement must be submitted to the Travel Guarantee Board no later than three months after the trip has been postponed or canceled.
